Terms and Conditions of myownerbuilder.com LLC © 2021

This is a legal agreement between you, the user, and myownerbuilder.com LLC.

By downloading and installing the Software you are agreeing to be bound by the terms of this agreement.

myownerbuilder.com LLC: Software License

1. GRANT OF LICENSE, SINGLE-USER.

myownerbuilder.com LLC grants you the license to use one copy of the enclosed myownerbuilder.com LLC program ( the "Software" ) on any computer, that you as a single user, own.

It is to be used by you on any one computer at a time. This would include a network server.

2. GRANT OF LICENSE, BUSINESS USE.

myownerbuilder.com LLC grants you the license to use one copy of the enclosed myownerbuilder.com LLC PER Business Location.

This would include a network server.

YOU MUST PURCHASE A COPY OF THE SOFTWARE PER BUSINESS

LOCATION, NOT JUST PER BUSINESS.

3. COPYRIGHT.

myownerbuilder.com LLC Builders Pro Software RT 1200

The above are protected by United States copyright laws and international treaty provisions.

Therefore, you must treat the SOFTWARE like any other copyrighted material ( e.g. a book or musical recording ) except that you may either ( 1) make a copy of the SOFTWARE solely for a backup or archival purposes, or ( b ) transfer the SOFTWARE to hard disk ( Only on computers you, as the purchaser own ) provided you then keep the original solely for backup or archival purposes.

You may copy the printed materials or on-line documentation.

4. TRADEMARKS and TRADE NAME

Windows 10 and other OS are trademarks of Microsoft

Corporation

MS Excel Versions are trademarks of Microsoft

Corporation

5. OTHER RESTRICTIONS

You may not rent or lease the SOFTWARE, but you may transfer the SOFTWARE and written materials on a permanent basis provided you retain no copies and the recipient agrees to the terms of this Agreement. You may not reverse engineer, decompile or disassemble the SOFTWARE.

If you transfer a computer that you own, and the SOFTWARE is installed on that computer, you must un-install any and all of the above Programs.

LIMITED WARRANTY

myownerbuilder.com LLC warrants that the SOFTWARE will perform substantially in accordance with the accompanying written materials for a period of 90 days from the date of receipt. Any implied warranties on the SOFTWARE are limited to 90 days. myownerbuilder.com LLC will replace, at no charge, defective downloads that are claimed defective within 90 days of the original date of purchase, provided that with testing they are deemed defective.

CUSTOMER REMEDIES

The entire liability of myownerbuilder.com LLC and its suppliers, and your exclusive remedy, shall be, at myownerbuilder.com LLC option, either (a) return of the price paid or (b) repair or replacement of the SOFTWARE that does not meet myownerbuilder.com LLC Limited Warranty and which is returned to myownerbuilder.com LLC with a copy of your receipt.

This Limited Warranty is void if failure of the SOFTWARE has resulted from accident, abuse, or misapplication. Any replacement SOFTWARE will be warranted for the remainder of the original warranty period or 30 days, whichever is longer.

NO OTHER WARRANTIES

myownerbuilder.com LLC and its suppliers disclaim all other warranties, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the SOFTWARE and the accompanying printed materials. This limited warranty gives you specific legal rights which vary from state to state.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES

In no event shall myownerbuilder.com LLC or its suppliers be liable for any damages whatsoever ( including without limitation damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss ) arising out of the use of or inability to use this myownerbuilder.com LLC product even if myownerbuilder.com LLC has been advised of the possibility of such damages.

U.S. GOVERNMENT RESTRICTED RIGHTS

The SOFTWARE and documentation are provided with RESTRICTED RIGHTS.

Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in subdivision (c) (1) (ii) of The Rights in Technical Data and Computer Software clause at 48 C.F.R. 252.227-7013, or in subdivision (c) (1) and (2) of the Commercial Computer Software-Restricted Rights Clause at 48 C.F.R. 52.227-19, as applicable.

This agreement is governed by the laws of the State of Idaho.
